By securing a charter or by utilizing our Service, you are indicating your agreement to these Terms. If you do not agree with these terms, you should refrain from accessing the Service.
2. Service Overview
CivicCommonsFoyer offers an array of high-end yacht rental services including, but not limited to:
- Yacht charters for the day
- Evening boat trips
- Executive retreats
- Exclusive gatherings
- Extended yacht excursions
Availability of services is contingent on scheduling and weather conditions. We maintain the right to alter or cancel services without prior notice at our discretion.
3. Booking and Reservations
3.1 Booking Process
For a successful charter booking, you must:
- Have at least 18 years of age
- Supply valid and accurate details
- Make a deposit payment as outlined in your booking details
- Consent to these Terms & Conditions
3.2 Confirmation
A charter booking is deemed confirmed only after we have received the payment and issued a written confirmation. We reserve the right to decline service to anyone based on our judgment.
3.3 Availability
We subject all charters to boat availability and apt weather conditions. We strive to accommodate your preferred charter dates and times to the best of our ability.
4. Payment Terms
4.1 Pricing
All prices are in € and include any relevant taxes unless specified otherwise. Pricing is subject to alteration without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the overall charter cost due upon booking
- Remaining balance: Payable 48 hours prior to the charter departure
- Incidental expenses (if applicable): Payable upon charter completion
4.3 Payment Methods
We accept most major credit cards, electronic bank transfers, and certified bank drafts. Our secure, encrypted mechanisms handle all payment processing.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before departure: Full reimbursement minus transaction fees
- 24-72 hours before departure: 50% reimbursement
- Under 24 hours before departure: No reimbursement
5.2 Weather Cancellations
Should our captain determine weather conditions as unsafe, we will propose to:
- Reschedule the charter to another available date at no extra charge
- Issue a full refund if rescheduling is unfeasible
5.3 Mechanical Issues
If there is a mechanical failure with the allocated yacht, we will endeavor to arrange an appropriate substitute. In the absence of a substitute, a complete refund will be granted.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Adhere to instructions from the crew
- Use the safety gear provided when necessary
- Disclose any medical conditions that could impact their safety
- Stay within the prescribed areas on the vessel
6.2 Prohibited Items
The following items are prohibited on the yacht:
- Glassware
- Forbidden substances
- Weapons of any kind
- Excessive amounts of beverages (beyond reasonable personal consumption)
- Animals (unless prior permission has been obtained)
6.3 Conduct
Guests are expected to behave respectfully. We reserve the right to cut short a charter, without a refund, if behavior from any passenger is dangerous or disrupts the pleasant atmosphere for others.
7. Liability and Insurance
7.1 Our Liability
Our liability to your charter is confined to the amount paid. We are not accountable for:
- Injuries to oneself stemming from one's negligence
- Loss or damage to personal belongings
- Indirect, incidental, or punitive losses
- Delays occasioned by weather or events not in our control
7.2 Insurance Coverage
We secure comprehensive insurance for our fleet and operations. Guests are advised to arrange their own travel and personal insurance.
7.3 Assumption of Risk
By partaking in our yacht services, you acknowledge that maritime activities have inherent dangers and you accept full responsibility for your safety and actions.
8. Modifications and Itinerary Changes
We reserve full discretion to modify itineraries, paths, or timetables due to weather elements, safety reasons, or operational necessities. We will exert reasonable efforts to offer similar alternative experiences.
9. Force Majeure
We shall not be held responsible for any hindrance, cancellation, or alteration brought about by forces outside our control, which include, but are not confined to:
- Harsh weather events
- Natural calamities
- Regulatory constraints
- Harbor closures
- Mechanical breakdowns
10. Privacy and Data Protection
Your private data is processed in conformity with our Privacy Policy. By procuring our services, you agree to the collection and utilization of your data as outlined in our Privacy Policy.
11. Intellectual Property
